End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between you and Power Punch Technologies, Inc. ("KAYYO") regarding your use of the Align by KAYYO mobile application (the "Licensed Application").

License

Power Punch Technologies, Inc. grants you a nontransferable license to use the Licensed Application on any Apple branded products that you own or control, as permitted by the Apple Media Services Terms.

Restrictions

• You may not copy, modify, or distribute the Licensed Application except as allowed by law.
• You may not reverse engineer or attempt to derive the source code.
• You may not use the Licensed Application to violate any law.

Maintenance and support

Power Punch Technologies, Inc. is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to provide support.

Warranty

Power Punch Technologies, Inc. is solely responsible for any product warranties, to the extent not effectively disclaimed.

Product claims

Power Punch Technologies, Inc., not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of it.

Intellectual property

In the event of any third party claim that the Licensed Application infringes intellectual property rights, Power Punch Technologies, Inc. will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Third party beneficiary

You acknowledge that Apple and Apple's subsidiaries are third party beneficiaries of this EULA and may enforce it against you.
